REAL ESTATE LAW

Our Real Estate Department, previously headed by David B. Zurav, deals with buying, selling, leasing and financing properties, and counseling with regard to joint ventures. We represents sellers, buyers and developers of office buildings, industrial facilities, resort properties, hotels, shopping centers and land, as well as single family units. Our attorneys handle leases ranging from ground leases for development projects to office, industrial and retail leases, on behalf of landlords and tenants. We work extensively and regularly with governmental authorities on condominium and common interest filings and related matters, including conversions of apartment units. We have extensive experience structuring and negotiating real estate joint venture agreements for development projects of every nature. We structure transactions, including tax-deferred exchanges.

The firm's attorneys have counseled clients or appeared before planning boards, boards of adjustment and governing bodies in municipalities throughout New Jersey in connection with zoning and land use matters. The firm has handled appeals of use variances to municipal governing bodies, counseled clients in disputes with municipalities concerning water and sewer connection fees, and appeared in municipal courts to defend zoning and other code violations. In addition, we counsel clients who oppose municipal efforts to rezone their property or nearby property which will affect them, along with clients who seek a zone change to permit a proposed development.

The firm’s practice extends to the full range of issues covered by the Lanham Act, including false and deceptive advertising, which is an area of increasing concern to some clients. In addition to copyright litigation, the Department also regularly handles the preparation and filing of copyright applications and works protected under the copyright laws, including computer software. The firm prepares copyright applications for works ranging from graphic designs to computer software, and from individual works to collective works.
